refund process

I bought an item and received it this week. The auction stated that the item was tested and working, it also states no returns. When I received the item it does not work. The item is a combustable gas detector and requires special rechargable batteries which costs 50 bucks to replace and the batteries in the item are dead and corroded. Which leads me to believe it wasn't tested as stated. I sent the seller an email threw ebay and explained the situation. He stated that I should ship the item back and he would offer a refund. He sent this message threw my yahoo email and not threw the ebay messaging. Also in his message he stated that he never used this, which also leaves me to believe he never tested it like his ad says. My question is how would you go about this return? I have this feeling in my gut like I am going to get the short end of the deal. The fact that he sent me a message outside ebay gives me a bad feeling. Also he has 10 negative feedbacks in the last month, should have not bought from him after reading that but he sells a lot and also has a lot of good feedback. One of his negatives says "got it and didnt work "tested and working" ...NOT!! bad seller, no contact" and another says "Didn't work, returned per agreement, did not refund". This last negative concerns me about getting ripped off. From what I understand ebay won't recognize his email to me stating he will refund because it was sent threw yahoo and not threw the ebay messaging system? Should I file a claim or email back asking him to email threw ebay? I'm just trying to make sure that I do everything I can to prevent him from receiving the item back and then not refunding me like one of his negatives says. Remember you have 60 days to leave FB for this transaction & only 45 days to file the claim. IMO don't email them unless its thru the message system & tell them you can only get responses from them thru ebay as well.|||File the SNAD claim right away then send the item back with delivery confirmation. This is a must because it is proof to paypal and ebay that you sent it back. Don't respond to the seller at all. Let the process work.|||File the SNAD dispute with Paypal as stated above. Only communicate with the seller via the dispute console. Escalate the dispute to a claim within 10 days after filing, no matter what or if the seller responds. Paypal will give you instructions of how and where to return the item with delivery confirmation. Thanks, Scott|||Pay pal has to give the seller 7 days to respond to the dispute and try to make right. Do not send until they tell you to. I have to admit I am having a hard time feeling for you. You admit to knowing about this sellers horrible feedback.... Thanks, Scott" I guess you did not read the selle'rs feedback OR Post #3 which tells you exactly what and when to do it.|||I did read post 3, I also read post 1 and 2 which both stated "file a claim and ship back the item" Was just double checking since I don't go threw this stuff everyday Thank you|||I did read the sellers feed back and I also did admit that I should have hit the back button after reading it. But I didn't and guess I hoped I would be one of the many positive feedbacks. Guess I like to give people the benefit of the doubt and now I"m paying for it. Yes I did take a chance and it didn't pan out, now I am trying to take care of the situation using the paypal process designed for these reasons. And there is a difference between buying something and receiving it and trying to take care of the problem and waiting 5 months for something to arrive. In my opinion there is a big difference. Maybe I was foolish for buying from a seller with a 97.9 feed back. Guess I will only buy from sellers with a 100% feedback and perfect stars, which would rule out most sellers on ebay.|||Also not asking anyone to "feel" for me. Both cases could have had easy resolutions...Yours was to not bid in the first place seeing the MANY red doughnuts before hand, and the buyer who waited 5 months for the item to arrive simply could have filed an INR after 45 days and had all of their money refunded.|||Don't let the crabby ones ruin your day. When you send back the item, be sure to get Delivery confirmation on it to prove the seller got it. If it cost more than $249 you must have Signature Confirmation. The process takes time but you will get your money back.|||Pretty in Pink, I agree with you and have stated numerous times that I did take a chance and I should have walked away after reading the feedback. I'm not asking anyone to feel sorry for me, just was asking about the refund process. I bought the item and now am working threw the process of returning it. The difference between this situation and the other one is I didn't wait around for 5 months before asking, I asked the day after I got it. I've had bad experiences at local stores, doesn't mean that I won't shop there. Point being is I bought an item that was said tested and works, it wasn't so now I will return it. I didn't buy an item and wait half a year and ask about a refund. Even most local stores don't refund after 5 months. Thank you to everyone that provided helpful suggestions on the return process.
